Provider: Flixconomy GmbH, Bovenheck 13, 52224 Stolberg, Germany. Commercial register: Amtsgericht Aachen, HRB 23121. VAT ID: DE359198596. Contact: support@flixconomy.com.
These terms govern the use of the inference API at api.flixconomy.ai ("the Service"). The Service is offered exclusively to businesses (entrepreneurs within the meaning of § 14 BGB) and to marketplaces that resell access to their customers, such as OpenRouter and Hugging Face. It is not offered to consumers.
The Service provides OpenAI-compatible access to open-weight language models running on our own hardware in Germany. Available models, context lengths and prices are published at https://api.flixconomy.ai/v1/models and https://api.flixconomy.ai/openrouter/models; for ari/support (Ari Support, formerly ari/coach, which still works as an alias) at https://api.flixconomy.ai/coach.
We aim for high availability and monitor the Service continuously, but we do not guarantee uninterrupted or error-free operation. Maintenance, hardware changes and events beyond our control may cause interruptions. When the Service is at capacity, requests are rejected with HTTP 429 rather than queued. Exception: the MCP server for ari/support (https://api.flixconomy.ai/mcp) holds a short queue of a few questions and rejects further ones at once.
Prompts and completions are processed in memory only and are not stored, logged or used for training. Exception: for the model ari/support (also when called by its old name ari/coach), questions, answers and Ari's internal reasoning about them are stored and become part of Ari's experience, as described in the Privacy Policy. Usage metadata is stored for billing as described in our Privacy Policy (https://api.flixconomy.ai/privacy). Where you send personal data, you are responsible for having a legal basis to do so; a data processing agreement under Art. 28 GDPR is available on request.
You must not use the Service to:
We may suspend access that violates these rules or endangers the Service.
Output is generated automatically by open-weight models (currently ari/ari-27b, based on Qwen3.8-27B under the Apache 2.0 licence and further trained by us, and ari/support (Ari Support), a decision service operated by Ari on that model) and may be inaccurate, incomplete or inappropriate. You are responsible for reviewing output before relying on it. The applicable model licence applies to the model itself.
Prices are those published at the time of the request. When you access the Service through a marketplace, that marketplace's terms govern billing and payment towards you.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. Any further liability is excluded.
We may change these terms with reasonable notice. Continued use after the change takes effect constitutes acceptance.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for merchants is Aachen, Germany.
Parts of the Service are operated by Ari, an AI system of Flixconomy GmbH, under the supervision of the company's management.
